2. PRODUCT SAFETY AND INTENDED USE

Please read this section before buying or using the product.

The Bellamy band is a consumer convenience device. It is not a medical device, it is not a medical alert system, and it is not a monitored emergency response service. It is not approved, cleared or registered by the U.S. Food and Drug Administration or by any equivalent authority, and it is not intended to diagnose, treat, cure or prevent any condition.

Pressing the button sends a notification to the mobile phones of the people you have chosen and set up in the app. It does not contact 911, emergency services, a call centre, a hospital, or any monitoring provider of any kind. No one is watching or listening on the other end.

The product depends on conditions we do not control, including a working home Wi-Fi connection, mains power to the router, sufficient battery in the band, a working mobile phone in the hands of each chosen contact, a working internet connection on that phone, and notifications being enabled and not silenced. If any one of these fails, the alert may be delayed or may never arrive.

For these reasons, the product must never be relied upon as the only way of getting help, and must never be used in any situation where a failure to send or receive an alert could result in injury or death. It is not a substitute for emergency services, professional medical care, professional monitoring, or in-person supervision. Anyone whose condition may require urgent medical attention should have access to a telephone and to emergency services.

Before relying on the band, set it up fully, add and verify your contacts, keep it charged, and test it. We recommend testing it at least once a month.

3. NO MEDICAL OR PROFESSIONAL ADVICE

The content on this website, including any statistics, articles or general information about falls, ageing or home safety, is provided for general information only. It is not medical advice and must not be treated as such. It is not a substitute for advice from a doctor, nurse, pharmacist or other qualified professional. Never disregard professional advice or delay seeking it because of something you read on this website. If you believe someone is having a medical emergency, call your local emergency number immediately.

4. THIRD-PARTY APP AND SERVICES

The product works with a mobile application provided by a third party. That application is not owned, developed or operated by us. Its availability, features, performance, terms of use and privacy practices are controlled by its provider and may change or be discontinued without notice to us. You are responsible for reviewing and accepting the provider's own terms and privacy policy before using the application. We are not liable for the application's performance, for any interruption to it, or for how its provider handles your data.

5. ACCURACY OF INFORMATION

We take care to describe our product accurately, but we do not warrant that all content on this website is complete, current or free of error. Product appearance may differ from photographs depending on your screen. Specifications, prices and availability may change without notice. If you spot something that looks wrong, please tell us.

The content of this website, including text, images, graphics and layout, is owned by us or used with permission, and is protected by copyright and other intellectual property laws. You may not copy, reproduce, republish or distribute it for commercial purposes without our written consent. Any third-party names, logos or trademarks that appear on this website remain the property of their respective owners and their appearance does not imply any affiliation with or endorsement by them.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by law, we are not liable for any injury, loss or damage arising from the use of this website or of our product, including any loss arising from a delayed, undelivered or unnoticed alert, or from reliance on the product in place of emergency services or supervision. Nothing in this notice excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

8. YOUR CONSUMER RIGHTS

Nothing in this notice affects the statutory consumer rights you have in your country of residence, including rights under the Australian Consumer Law, the consumer protection laws of the United Kingdom, the consumer protection laws of your Canadian province or territory, and the consumer protection laws of your U.S. state. Where this notice conflicts with those rights, those rights apply.

9. GOVERNING LAW

This notice is governed by the laws of Argentina, where the seller is located. This does not limit any right you may have to bring a claim in your local courts or to rely on the mandatory laws of your place of residence.
